Warranty and Service Terms Agreement

Acceptance of Terms: 
By contracting our services, you agree to abide by the following terms and conditions.
 

Warranty of Services:

Pool Paint Screen LLC guarantees its services against defects in materials and workmanship under normal usage and proper maintenance during the warranty period. We will repair or replace, at no additional charge, any defective product or component resulting from improper materials or workmanship.

Exclusions: 

This warranty excludes damages caused by weather-related events, including storms, hurricanes, hail, extreme winds, fires, or natural disasters. It does not cover normal wear and tear, climate exposure, damage from animals, third-party interference, or issues unrelated to materials or workmanship

Worksite Safety & Liability:

For the safety of all parties involved, we strongly advise that customers, tenants, and pets avoid entering the worksite while work is in progress. This includes the pool cage area and surrounding work zones where materials, tools, and equipment may be present.

 

While we take all necessary precautions to ensure a safe work environment, Pool Paint Screen LLC is not responsible for any injuries or damages that may occur on the worksite, whether workers are present or not. Customers and tenants acknowledge that entering the work area is at their own risk. Additionally, customers and tenants are solely responsible for the safety of their pets, minors, and any other individuals or animals that may enter the worksite, regardless of ownership. Pool Paint Screen LLC assumes no liability for incidents involving any persons, minors, or animals entering the worksite, as previously mentioned.

Project Completion & Inspection:

As part of the project, photos and videos may be taken for marketing purposes, including ads, commercials, and instructional content, always with the utmost respect for our customers’ privacy. No personal information will be disclosed. Unless the customer provides a written objection, this content may be used publicly on our online profiles.

 

Upon project completion, it is crucial to conduct an in-depth walk-around inspection of the area with the team manager to ensure that everything has been completed as expected. If any issues are identified or warranty claims arise after project completion, the team will have up to 30 days to address them.

Policy on Defamation, Interference, and Payments:

Pool Paint Screen LLC enforces a strict no-tolerance policy regarding, but not limited to, any content or actions that could be considered defamatory, misleading, or harmful to the company’s finances or reputation, including threats toward the company or any of its employees, interference with work, or withheld or unpaid payments of the agreed invoice, or failure to pay the agreed invoice balance of the total project price by the invoice due date. Additionally, any request by the customer to delete their personal data from our system, as outlined in our Cookies Policy, will result in the automatic forfeiture of any active warranties. The removal of such data prevents Pool Paint Screen LLC from maintaining essential records related to project details, service history, and warranty claims, making it impossible to honor any remaining warranty obligations. Such actions will result in the automatic forfeiture of the warranty and may lead to the suspension of any ongoing work on the project, at the sole discretion of Pool Paint Screen LLC.

 

In the event of such a suspension or termination, the customer waives any right to pursue legal action against Pool Paint Screen LLC, its owners, employees, or affiliates. Additionally, the customer agrees to indemnify and hold Pool Paint Screen LLC harmless from any claims, damages, losses, or legal expenses incurred as a result of enforcing this policy. Should the customer initiate any legal proceedings despite this agreement, they shall be fully responsible for all legal fees and costs incurred by Pool Paint Screen LLC in defending against such claims.

Furthermore, in the event of project cancellation due to any of the reasons outlined above, Pool Paint Screen LLC reserves the right to retain any down payment made as compensation for costs incurred in preparation, labor, materials, or other related expenses. If no down payment has been issued, the customer remains fully liable for the payment of any outstanding invoices to cover expenses already incurred by Pool Paint Screen LLC in connection with the project. Pool Paint Screen LLC retains the right to take necessary legal action to enforce payment of such amounts.

 

Pool Paint Screen LLC reserves the right to modify, update, or amend these terms at any time without prior notice. The latest version of these terms will always be available upon request and shall govern all ongoing and future agreements.
